Standards for Canadian Health Data Protection During A Health Emergency – An Analysis of Privacy Regulations and Laws.

Health emergencies require unprecedented measures to protect the public from a health disaster. Such actions may require limiting personal freedom and other rights like data privacy. The limitation, however, should be temporary and proportionate so that privacy rights are not compromised superfluously. The Canadian privacy laws, in general, are sector driven and not harmonized at the national level, and there is no new guidance on data usage during emergencies. Hence this presentation will look at the laws and regulations in Canada and encapsulate appropriate standards for Canada’s health data protection for better management of health data privacy.

Prof. Jawahitha Sarabdeen, Fellow (FCG) of The Chartered Governance Institute Canada (CGIC), Barrister & Solicitor, Ontario, Canada, Ph.D. (MMU), MCL(IIUM), MSHRM(UOW), LL.B. (Hons)(IIUM), CLPP(TMU).

Prof. Sarabdeen is a highly motivated legal professional and an award-winning researcher and university professor with diverse global experience in corporate and business law; she widely researched and published data privacy laws, business law, and technology law.

Her achievements include over 70 refereed publications in top-tier journals, conference proceedings, and book chapters during her 21-year-long excellence in her career. She has received several prestigious awards and grants in postdoctoral education, research, teaching & related activities, and research collaborations, and she has also counseled on litigation, business, and corporate matters. Prof. Sarabdeen was honored to act as an invited reviewer, speaker, conference session chair, and committee member for various international institutions and organizations. She is a trainer and consultant to professionals from the Education, Healthcare, IT, Petroleum, Telecommunications, Banking, and Finance industries.
